GENERAL TERMS AND CONDITIONS OF SALE
These general terms of sale describe both terms and conditions applicable, on the one side, to Cave des Vignerons de Pfaffenheim, situated in 68250 PFAFFENHEIM, and registered with the Colmar Trade and Companies Association under number 778960039, and, on the other side, to any customer, individual or corporation, interested in making a purchase via the Cave des Vignerons de Pfaffenheim's internet site.
We recommend that you carefully read the Contract (as defined hereunder) before using the Site and/ or before passing an order with Cave des Vignerons de Pfaffenheim: this contract affects your rights and obligations.
The present sales conditions define the contractual relationship between Cave des Vignerons de Pfaffenheim and the buyer, as well as the conditions applicable to any purchase made via the Cave des Vignerons de Pfaffenheim's online boutique, by any individual or corporation. Acquiring goods or services through this site means that the buyer accepts the present sales conditions without reserve.

The products and services on offer are those included in the catalogue published on the site of Cave des Vignerons de Pfaffenheim. Our promotions and prices are valid and subject to stock availability. The photographs illustrating the products in the catalogue are as accurate as possible, but do not pretend to be a perfect reproduction, especially in terms of color.
The prices featured in the catalogue are net in euros, including the VAT application on the date of the order, all changes in rate can be passed into the price of the products and services. Cave des Vignerons de Pfaffenheim reserves the right to change its prices at any time. However, it is understood that the price appearing in the catalogue on the day of the order, will be the only applicable one the purchaser. The prices indicated on the product sheets do not include the costs of delivery. Shipping is free of charges as of 24 bottles. The fixed price for smaller orders is 27€ per recipient.
The online sales of products and services listed on the site are limited to customers who reside in metropolitan France and for orders placed in theses geographic zones.
To purchase a product or a service you must:
- Be at least 18 years old and have full legal capacity or hold parental consent authorizing the placement of an order on the website, and be able to supply proof of this capacity, upon request;
- Fill in the identification form with the required details, including eventually your customer account number;
- Fill in the online order form with the references of the selected products or services;
- Confirm your order after checking it;
- Pay according to the instructions;
- Confirm your order and payment.
Any placement of an order implies your unreserved acceptance and complete comprehension of these general sales conditions, as well as the renunciation of one's own terms of purchase or other conditions. All of the provided data and the recorded confirmation shall constitute proof of this transaction. Confirmation shall be deemed a signature and acceptance of transactions. The seller will send an email to confirm the order. We reserve the right to cancel part of or the entire order in the event of supply problems, as well as, in the event of a force majeure or any other legitimate reason. In this case, you will be contacted as soon as possible and you will be entirely refunded in relation to the cancelled order.
In accordance with the General Terms and Conditions of Sales of Cave des Vignerons de Pfaffenheim, an order will be refunded upon receipt of the purchased products, which must be returned no later than 14 working days, following the expedition of the withdrawal form. The cost of sending back the products will be at the charge of the buyer. If this period expires on a Saturday, a Sunday, a bank holiday or other non working day, it will be extended to the first working day thereafter.
Payment is required at the time of ordering.
Payment will be made by bank card; processed by the CIC security system which uses the SSL (Secure Socket Layer) protocol in such a way that the information transmitted will be encrypted and no third party will be able to intercept this transaction during transmission throught the network. Your account will only be debited for the amount of products ordered and actually delivered.
By check for banks based in France. The check will be immediately deposited upon its reception. It must be made out to "La Cave des Vignerons de Pfaffenheim" and sent to the following address: - 5 rue du Chai - 68250 PFAFFENHEIM
The order will be delivered at the address on the order form, that has to be located within metropolitan France. We have selected highly reliable and serious transport companies to handle our shipping requirements. Your packages will be carefully delivered at the indicated address. Depending upon the distance, your order will take between 7 and 10 days to arrive. Do not forget to mention, upon observing any damage, the details of the problem on the delivery receipt and to inform us as soon as possible. The box or the missing elements, will be entirely replaced free of charge.
All products sold by the vendor are covered by the legal guarantee as stipulated in articles 1641 and according to the French Civil Code. In case of non compliance we will exchange or refund the purchased product. All the complaints, requests for exchange or refunding must be carried out by post to the following address: Cave des Vignerons de Pfaffenheim - 5 rue du Chai - 68250 PFAFFENHEIM within 14 days from the date of delivery.
The salesman, in the process of an on-line sale, is held only by a best effort undertaking; his responsibility cannot be committed for any damage arising from the use of the Internet such as losses of data, intrusions, viruses, disruptions of service or other involuntary problems.

Electronic files are allegedly accepted by all parties as a simplified proof of exchanges, orders, payments and other transactions between parties.
These terms and conditions are governed by French law.
In the case of litigation, the customer should first contact Cave des Vignerons de Pfaffenheim, to try and obtain an amicable solution. Failing that, the only competent courts are those of Colmar (Haut-Rhin) in settling any lawsuit.
